ARTICLE 1 – PERSONAL INFORMATION WE COLLECT


When you make a purchase on Pokémon Shop, as part of our buying and selling process, we collect the personal information you give us, such as your name, your address, your email address and your phone number.

When you browse Pokémon Shop, we also automatically receive your computer's Internet Protocol address (IP address), which gives us more details about the browser and the operating system you use.

As part of our email marketing, and with your permission, we may send you emails about Pokémon Shop covering new products and other updates, or orders you did not complete.



ARTICLE 2 - CONSENT

How do we obtain your consent?

When you give us your personal information to complete a transaction, verify your credit card, place an order, arrange a delivery or return a purchase, we assume that you consent to our collecting your information.

If we ask you for your personal information for another reason, for marketing purposes for example, we will either ask you directly for your explicit consent or give you the option to decline.

How can you withdraw your consent?

If, after giving us your consent, you change your mind and no longer agree to let us contact you or collect your information, you can tell us by writing to contact@pokemon-shop.fr


ARTICLE 3 – DISCLOSURE

We may disclose your personal information only if the law requires us to do so or if you violate our Terms of Sale and Use.


ARTICLE 4 – SHOPIFY

Pokémon Shop is hosted by Shopify Inc. They provide us with the online commerce platform that lets us sell you the services and products of Pokémon Shop.

Your data is stored in Shopify's storage system and databases. Within Shopify's general application, your data is kept on a secure server protected by a firewall.


For payment, if you complete your purchase through a direct payment gateway,  Shopify will store your credit card information. That information is encrypted in accordance with the security standard set by the payment card industry (the PCI-DSS standard). Information about your purchase transaction is kept only as long as necessary to complete your order. Once your order is complete, the purchase transaction information is deleted. We therefore have no direct access to the information you used to place your order. That information passes through Shopify and the payment processors.

Indeed, all direct payment gateways comply with the PCI-DSS standard. This payment card industry security standard, PCI-DSS for Payment Card Industry Data Security Standard, is 
set by the five major card networks (VisaMasterCardAmerican ExpressDiscover Card to JCB). These standards help ensure that credit card data is handled securely for your purchases on Pokémon Shop and by its service providers.

ARTICLE 5 – SERVICES PROVIDED BY THIRD PARTIES


In general, the third-party providers we use will only collect, use and disclose your information to the extent necessary to perform the services they provide to us, such as payment processing.

However, some of these providers, such as payment gateways and other payment transaction processors, have their own privacy policies covering the information we are required to give them for your purchase transactions on Pokémon Shop.

As for these third-party providers, we recommend that you read their privacy policies carefully so you can understand how they will handle your personal information. You can find Visa's here, American Express's here, MasterCard's here, JCB's here and Stripe's here.

Keep in mind that some of these third-party providers may be located, or have facilities located, in a jurisdiction other than yours or ours. So if you decide to go ahead with a transaction that requires the services of a third-party provider, your information may then be governed by the laws of the jurisdiction where that provider is located, or by those of the jurisdiction where its facilities are located, for example.

For example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, the information belonging to you that was used to complete the transaction could be disclosed under United States law, such as the Patriot Act.

Once you leave Pokémon Shop or are redirected to a third party's website or application for your payment, you are no longer covered by this Privacy Policy or by the Terms of Sale and Use of Pokémon Shop.

ARTICLE 6 – SECURITY

To protect your personal data, we take reasonable precautions and follow industry best practices to make sure it is not lost, misused, accessed, disclosed, altered or destroyed inappropriately.

If you give us your credit card information, it is encrypted using the SSL security protocol and stored with AES-256 encryption. This means that no human being has access to the full card number. Although no method of transmission over the Internet or of electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional standards generally recognized by the industry.


COOKIES

Below is a list of the cookies we use. We have listed them here so you can choose whether or not to allow them.

_session_id, a unique session identifier that lets Shopify store the information about your session (referrer, landing page, etc.).

_shopify_visit stores the cookies from the last visit for 30 minutes. After that, no data is recorded. This cookie is used by the internal statistics tracking system of the provider of Pokémon Shop to record the number of visits.

_shopify_uniq, this cookie expires at midnight the following day, based on the visitor's location. It counts the number of visits to a store by a unique customer.

cart, this unique identifier lasts for 2 weeks and stores the information about your shopping cart.

_secure_session_id is a unique session identifier.

storefront_digest is also a unique identifier. It is undefined if the store has a password. It is used to know whether the current visitor has access or not.


ARTICLE 7 – AGE OF CONSENT

By using Pokémon Shop, you confirm that you are at least the age of majority in your country, state or province of residence, and that you have given us your consent to let any minor in your care use Pokémon Shop.


ARTICLE 8 – CHANGES TO THIS PRIVACY POLICY

We reserve the right to change this privacy policy at any time, so please review it regularly. Changes and clarifications take effect as soon as they are posted on the website. If we change the content of this policy, we will tell you here that it has been updated, so you can see what information we collect, how we use it and under what circumstances we disclose it, if we do.

If Pokémon Shop is acquired by or merges with another company, your information may be transferred to the new owners so that we can keep selling you products.

ARTICLE 9 - SMS MARKETING

By entering your phone number at checkout and starting a purchase, and by subscribing through our marketing sign-up list, you agree that we may send you SMS notifications (about your order, including abandoned cart reminders) as well as SMS marketing offers.

The number of marketing text messages will not exceed 30 per month. You can unsubscribe from any further text messages by replying with the word STOP. Sending text messages or using automation requires you to provide the recipients' phone numbers or names. This data is stored and used to report campaign analytics and results, including message delivery status, sending status and, in some cases, whether the purchase resulted in a sale for Pokémon Shop.

If you decide to use our link shortener in text messages, we will collect that information to know whether or not the link was clicked and will use it to display the results in the analytics. For any other third-party service you may decide to use outside the scope of smsbump.com, our text message operator and the system we use to send SMS (third-party link shortener, GA tracking, etc.), you will be referred to their specific third-party policies, which you must accept.

When text messages are sent, we pass the data to our text message operator so that the messages can be delivered. The information is shared with our operator only when a marketing and messaging campaign is started. If recipients no longer wish to receive messages, they must reply to the message with STOP or write to contact@pokemon-shop.fr so that we can unsubscribe you successfully.
